Judge Dismisses Marine's Defamation Lawsuit Against Murtha

A Marine who sued Rep. John Murtha for defamation has lost his bid in court.Staff Sgt. Frank Wuterich claimed Murtha damaged his reputation by saying he and fellow Marines killed Iraqi women and children "in cold blood" in Haditha.Tuesday morning, a U.S. Court of Appeals judge dismissed the lawsuit and ruled that Murtha has immunity because he was acting in his official role when he made those comments.Another lawsuit filed by a Marine from Washington County, Pa., is still pending.Stay with WJAC-TV News and WJACTV.com for continuing coverage.
