APD officer cleared in shooting of man

HOLLIDAYSBURG, Pa. -- The Blair County District Attorney's office and Pennsylvania State Police say an Altoona police officer who shot and wounded a man in April was justified in doing so.

District Attorney Richard Consiglio said Friday the investigation into the April 7 investigation was completed and the shooting was a result of the man's actions, and no charges would be filed against anyone involved in the case.

"The civilian's injuries, while certainly very regrettable, occurred due to the civilian's own conduct, which was the major contributing factor in the incident," Consiglio said in a news release.

The officer, who was not named, shot and wounded a man in a home at 1615 16th Street about 11:15 p.m. after the man was found to have a knife in his possession and was trying to harm himself, Consiglio said.

The officer found the man in a room with the knife, Consiglio said. The investigation found the man turned toward the officer with the knife and appeared to approach him. At that time, the officer fired one shot, striking the man.

The man showed no signs of being shot, and had to be subdued by officers following a short struggle, investigators said. Officers had to use pepper spray and were able to wrestle the knife away from the man.

Police said no charges would be filed against the officer and it was decided no charges would be filed against the man at this time.
