Clark has been held for nearly 20 months charged with kidnapping and killing Holly Notestine in 2000.
His trial is scheduled for June, but his attorney argued that the case should have gone to trial in a year or less.
Clark asked Judge Daniel Howsare for permission to appeal the issue to state superior court.
