Accused Murderer Says He Can't Get Fair Trial

A man charged with murder in two counties said he wants at least one of those trials moved because he said he can't get a fair trial.

Nathan Fortson is charged with the killings of Velda Malloy and Dale Zunich.

A change of venue would mean jury selection would take place in another county, then that jury would be brought back to Cambria to hear the case.

District Attorney Pat Kiniry said Fortson's attorneys have to prove three things for their request to be approved: First, that there has been an extensive amount of pretrial publicity; second, that publicity saturated the community so any potential juror would know about the case; and third, that there has not been a sufficient "cooling off" period from the publicity until jury selection.

Kiniry said in most cases, a change of venue is granted.
