Cambria Co. prosecutors won't pursue death penalty in 2 separate homicide cases

CAMBRIA COUNTY, Pa. —

Cambria County prosecutors will not pursue the death penalty in two separate homicide cases.

The first case is for Patrick Burkett, of Beaverdale, who is charged with the shaking death of 22-month-old Raegan Panick. The toddler was his girlfriend's daughter.

The Tribune-Democrat reported that Burkett entered a not guilty plea at Tuesday's arraignment.

Police said he was watching the child on Aug. 10 when the mother found the toddler unresponsive when she came home. Burkett could face a life sentence if convicted.

In a separate case, prosecutors in Northern Cambria said 43-year-old Sherman Holes could also face a life sentence.

Holes, 43, of Indiana County, is accused of the beating death 79-year-old Arthur Henry.

The Tribune-Democrat reported that Henry was found nearly unconscious two years ago in his Northern Cambria home. Prosecutors said DNA evidence linked Holes to Henry's death.

Holes pleaded not guilty on Tuesday.
