Cambria County father charged in baby son's death

CAMBRIA COUNTY, Pa. —

A father of two was slapped with multiple charges and suspected of killing his seven week old son.

We were there last night when police escorted Justin Charles in handcuffs. Friday, he was sitting in jail and facing criminal homicide charges and third degree murder.

The affidavit simply calls the seven-week-old baby, J.C. Police say he is the son of 23-year-old Justin Charles who’s now facing charges in his death.

Adams Township EMS responded to a call of a non-responsive baby at this trailer on Liberty Park in South Fork. J.C. was life-flighted to Children’s hospital in Pittsburgh, where he died December 23rd, 2011.

"There was a verbal finding at the autopsy that the cause of death was a severe brain injury, and that there was no natural explanation for this type of injury," Cambria County District Attorney, Kelly Callihan said.

Investigators say the autopsy also revealed several fractures in the baby’s legs and hemorrhaging, and these deadly injuries weren’t the first time this baby has had to fight.

"We learned through this investigation that this child had been subject to severe child abuse since he was about two weeks old, and that was perpetrated on him by the father who we have arrested," Callihan said.

Investigators said the mother wasn’t home at the time and is not considered a suspect in this case.

"That child didn't have a voice anymore and it didn't have really anything; somebody pushing for him and that's what we did. We worked this case for him," detective Kevin Price said.

If convicted, Charles is looking at 20 to 40 years behind bars with just the third degree murder charge. That maximum sentence does not include the numerous counts of aggravated assault he’s also charged with.

The criminal complaint said Charles admitted to grabbing and squeezing the baby’s legs on four different occasions from November 12th, 2011 to the time the baby died.
