Police say Windber teacher, Frank Blair, Junior, had a blood alcohol level more than twice the legal limit when he got behind the wheel of his truck and caused a head-on collision with a single mom, killing her instantly.
Now, the Windber club where Blair was allegedly drinking earlier in the day, is under investigation.
Officials say Blair was at a private party at the Abbruzzi Lodge just before the fatal accident on Route 56 Sunday night. State police have assigned a liquor control enforcement officer to interview club employees and patrons who may have been there on Sunday.
Officer Dennis Smolko says if Blair was visibly intoxicated, and he was served more alcohol, the club and bartender could be charged. Smolko says it comes down to common sense.
"If you look at someone and say 'I know they shouldn't have another beer' and then serve them another one, that's the line that you've crossed," said Smolko.
If charged, the club could lose its liquor license and the bartender could face anything from a $1,000 fine to jail time.
