Company Appeals To Supreme Court To Mine 300 Feet From Homes

The state has issued a permit for a controversial strip-mining project in Cambria County, but it is still not known how close the mining will ultimately be to homes.

Hoffman Mining previously requested that officials override an ordinance that restricted mining within 1,000 feet of homes. The mining company instead wanted to open up a surface mine in Adams Township and mine 300 feet from homes.

The mining company was denied that request by a county court and the Commonwealth Court. Now, mining officials are appealing to the Supreme Court for permission.

Residents have said they fear for their safety. They said if mining companies are allowed to mine within 300 feet of their homes, the debris could affect their homes. Adams Township Solicitor Bill Barbin said he is confident the Supreme Court will rule in the township's favor.

Hoffman Mining has received a permit to mine around the coal seams of Upper Kittanning, Upper Freeport and Lower Freeport. Adams Township officials said they have no problem with that permit because it is still inside the 1,000-foot guideline.
