Coroner's Jury Recommends Murder Charges

DA Must Decide On Murder Charges Against Parents

Cambria County —

After an hour of deliberation and a day of testimony, a coroner's jury recommended murder charges against both Kenya Martin and Shawn Leverette.

The couple's 17-month-old baby, Tijhuan, died in January. He had been on a ventilator since birth because of a brain damage. Six jurors heard testimony, Tuesday, during a coroners inquest.

Tijhuan's parent's testified the ventilator was malfunctioning the day he died, and they did everything they could to try to fix it. Martin and Leverette testified that medical personnel told them if Tijhuan was too sick he needed to be admitted to a Pittsburgh hospital through Lee hospital. The child was taken to Lee the afternoon of January 22nd. Tijhuan was taken back to Lee Hospital around 9 p.m. but he was already dead.

A juror asked the mother why they didn't call 9-1-1 sooner if the machine didn't work right.

Medical professionals detailed two admissions to Lee Hospital in Johnstown. The ER doctor testified the father would not let them start treatment because he wanted Tijhuan sent to Pittsburgh. But the ER doctor said the weather was too bad to do that. According to the doctor, the boy's parents took him home against medical advice.

Kenya Martin said, "We don't know if he was in pain. All we know is that he was there and we loved him and we loved him for as long as we can."

Following Tuesday night's decision to recommend murder charges be filed by the District Attorney, Cambria County Coroner Denny Kwiatkowski said he had mixed feelings about the outcome, but was happy with the recommendation. He said he the jurors did a good job, asked good questions and really got to the root of the investigation.

Cambria County's DA will now take the recommendation and decide if murder or any charges should be filed against Tijhuan's parents.
