District Magistrate Stripped Of Position

A Cambria County District Magistrate, facing misconduct accusations, is removed from his judicial office. The Pennsylvania Court of Judicial Discipline announced that decision Tuesday.

First Allan Berkhimer lost the May election, now he loses his office as District Magistrate after he's accused of acting crudely and inappropriately at work.

The Judicial Conduct Board presented its case in two parts. First they said Berkhimer used "(Foul) language and behavior unbecoming a judicial officer." The second part of the case states "improper use of county employees, equipment and funds."

Joseph Massa, Jr., Chief Counsel to the Judicial Conduct Board says he's pleased with Berkhimer being removed from his judicial office.

Massa says, "The board felt strongly that Berkhimers's coarse and vulgar behavior was inappropriate and brought the judicial office into disrepute and warranted removal from the bench. The court's ruling has vindicated the board's conclusions."

The Conduct Board heard testimony in the case against Berkhimer in mid-December. On June 15th, the board filed an official complaint against him. Now on Tuesday, the decision to strip Berkhimer of his judicial position was announced.

Not all of the judges on the Conduct Board agree with the decision. One of them says the punishment was too harsh and that judge, instead, wanted to suspend Berkhimer for six months without pay.
