Hearing Held For Veteran Accused Of Killing 2

HOLLIDAYSBURG, Pa. —

A shooting victim was one of the first to testify during a preliminary hearing for an Iraqi War veteran charged with shooting her and killing two others.

Security was tight as Nicholas Horner was brought to the Blair County Courthouse around 7 a.m. About 75 people packed into the courtroom for the preliminary hearing.

When Horner walked into the room, many of the victims' family members sobbed. Four witnesses had testified by noon, and Horner sat between two constables wearing a bulletproof vest.

Horner, of Altoona, is accused of shooting two employees, one fatally, at the Subway sandwich shop on 58th Street and killing another man.

The rampage started around 5 p.m. on April 6 at. Police said Horner shot worker Michele Petty, who survived the attack, and Scott Garlick, a student at Hollidaysburg High School who was killed.

Also killed was Raymond Williams, an Altoona man who police believe Horner encountered as he was escaping from the Subway shop.

The first witness at Friday's hearing was Petty, who fought back tears as she recalled the attack.

She said Garlick arrived at the sandwich shop and started his daily routine. When Garlick took the garbage out, Petty said she heard loud banging noises. Petty went outside to check on Garlick and said it seemed like fireworks were coming at her. She said she fell to the ground and a man told her, "Don't get up or else."

She said she tried to look for Garlick but was reprimanded by the shooter. She curled up into a ball with her face down and said she heard the man demand money from another employee inside the store.

She said the shooter came back outside and told Garlick, "I'm sorry. I didn't want to have to do this to you."

Petty said she did not see the shooter's face, but said the voice was the same as Horner's. Two other witnesses on Friday identified Horner as the shooter.
