Johnstown shooting suspects receive jail sentences

CAMBRIA COUNTY, Pa. —


Two men convicted of gunning down another man in the parking lot of Oakhurst homes in 2011 learned their jail sentences on Tuesday.

It was only about six weeks ago when J'quan Lewis' mother spoke out at the convictions handed down to her son's killers. On Tuesday she spoke out again, this time against their sentences saying justice has not been served.

"There is no good days for me," said Evelyn Lewis. "There is no happy times."

"I still have a three-year-old I have to raise by myself without his father," said Jaquana Badger. "So, closure? No."

Lewis' mother, girlfriend and son spoke to 6 News just minutes after his convicted killers were handed their sentences.

"It will always be a thorn for me that Jquan cannot smile," said Evelyn Lewis.

Prosecutors said Marquis Neal shot and killed Lewis outside the Oakhurst homes housing project in October 2011. Police said Anthony Harvey was Neal's accomplice driving the get-away car. 

"This was a painful death. The first shot pierced one lung, the second pierced another lungand the third was execution style into the head area," said Cambria County District Attorney Kelly Callihan. "He had no chance. He was running for his life and died a terrible death."

A jury found both men guilty in January. On Tuesday a judge sentenced Neal to 25 to 50 years in jail. Harvey was sentenced to seven years, 10 months to 25 years in jail."

"Under the circumstances and the manner it happened, I think I had prepared my client for the sentence," said defense attorney Paul Eckenrode.

"I think the judge sent a message here that needed to be sent that this type of activity is not going to be tolerated anymore in the city of Johnstown," said Callihan.

For Lewis' friends and family, the sentence isn't enough.

"It's not okay," said Evelyn Lewis. "Twenty-five years, a lifetime would never be enough."

Neal did offer an apology to his family and Lewis' before he was sentenced. His attorney, Bob Gleason, told 6 News he plans on filing an appeal, saying Neal's punishment does not fit the crime.
