Man sentenced after crashing, killing motorcyclist while DUI

SOMERSET COUNTY, Pa. —


A man who crashed his SUV into a motorcyclist while drunk will spend at least nine months in jail. The victim's family had hoped Wednesday's sentencing would bring them closure.

Wednesday was a day Edward Helsel Jr.'s family had been waiting for for two years. It was a chance for them to finally see some justice for his death. But when the ruling came down they were left wanting more.

It was September 2010 when Helsel was riding his motorcycle along Somerset Pike in Conemaugh Township when he was struck and killed by a drunk driver.

"He wasn't speeding," said Helsel's father, Edward Helsel Sr. "He was coming back when this guy pulled right in front of him."

Robert Hauser pleaded guilty to involuntary manslaughter and DUI in July. Before his sentencing in court on Wednesday, Hauser told the family there's not a day that goes by that he doesn't think about what happened, saying he is truly sorry for his role in the terrible tragedy.

"It's not enough, but I think he is sorry. I mean I wouldn't want to hurt somebody and take somebody's life," said Helsel Jr.'s mother, Brenda Bertram. "I don't think the man meant to do it but when you drink and you drive that car you gotta take on the responsibilities."

Somerset County District Attorney Lisa Lazzari-Strasiser said it wasn't Houser's first DUI, it was his second. And the victim's father said he knows of other times it's happened after the accident.

"I sat in the bar room ... He didn't know me ... I sat in there for an hour and a half, watching him drink," said Helsel Sr. " He went out and got into his vehicle and drove off ... That's not fair."

The judge sentenced Hauser to spend between nine and 23 months in jail, but Helsel's family said it's not enough.

"He killed an innocent person," said Helsel's sister, Sarah Gongloff. "He should not have been drinking and driving and I think that people who drink and drive should get more time than that."

"There is a standard range of sentence that is suggested by the guidelines and that's what the suggested guideline range was," said Lazzari-Strasiser. "It's tragic."
