Northern Cambria Double Fatal Defendant Heads To Court

HASTINGS, Pa. —

Northern Cambria police charged Michael Sherwood with several charges including homicide by vehicle DUI. On Thursday, Sherwood had his preliminary hearing, and Judge Michael Zungali agreed the state had enough evidence to send the case to trial.

Several witnesses took stand, some who said Sherwood was speeding.

In September 2010, police said Sherwood crossed the centerline and crashed head-on into a car with three people inside.

Police said Richard and Lois Davis died in the crash, and the third passenger, Orlando Veltre, was severely hurt.

Veltre testified and said, "It happened in seconds; we had no where to go."

Police said Sherwood had a dose of methadone at a Johnstown clinic earlier in the day.

Trooper Bradley Overdorff was the state's expert drug and accident reconstruction witness.

Defense Attorney Tom Dickey objected to Overdorff's testimony, but the judge overruled.

Overdorff testified there were several drugs in Sherwood's system, including methadone.

Assistant District Attorney Gary Jubas said it doesn't matter how much he had in his system, that makes him incapable of driving.
