Police officer justified for shooting suspected gunman

D.A. says officer justified for using deadly force

RICHLAND TOWNSHIP, Pa. —


A Cambria County police officer took proper action when taking down a suspected gunman with a bullet. That's the final determination from the district attorney.

Police said Kevin McGee walked onto the Richland Township municipal building parking lot Sept. 13 with a loaded shotgun. Investigators said he was there for one reason: to attack a police officer who had arrested him months ago.

"This person had sent a letter to the DA's office in the weeks prior to the  incident voicing concern over a Richland Township officer who had previously arrested him for drug charges," said Cambria County District Attorney Kelly Callihan.

Court records show McGee was arrested in February. Callihan said it was that officer McGee was targeting when he showed up with a shotgun.

"Prior to the assault there was an officer who had left the building," said Callihan. "A difference of 20 minutes to a half hour of timing and we could have had an officer that was gunned down."

Police said McGee drove himself to the Richland Township municipal building and shot out the windows of a police cruiser in the parking lot.

"One officer looked out the window of the station and could see the defendant with a firearm loaded," said Callihan. "He turned the gun on that officer and it pointed directly at him."

That's when Callihan said officer John Lucas opened fire through the window, shooting McGee in the stomach.

"Because he was confronted with deadly force, not only against him, but against fellow officers and other people in that township building, I feel he was justified in taking the actions he did to stop the situation," said Callihan.

McGee was in the hospital up until last week. He's now behind bars in the Cambria County Prison awaiting his preliminary hearing week.
