Possible Death Penalty Case In Somerset County

Prosecutors in Somerset County say they'll seek the death penalty against a man accused of killing his girlfriend's 17 month old son.

The District Attorney says his decision for the death penalty against Todd Mitchell is based on the age of the victim, little Alexander Stull. Police say Mitchell was home alone with the boy and another child in April 2002 when Alexander suffered traumatic head injuries, from which he died. Mitchell's trial begins September 9th, and if convicted he would become the first Somerset County resident sent to death row in 70 years.
