Blair Co. DA to seek death penalty in 2004 murder

HOLLIDAYSBURG, Pa. -- The Blair County District Attorney will seek the death penalty in a retrial in the murder of a woman found dead in a lake nearly 10 years ago.

District Attorney Rich Consiglio filed notice Tuesday of his intent to seek the death penalty again Paul Aaron Ross, 41, in the 2004 death of Tina Miller, 26, the Altoona Mirror reported.

Ross was convicted of first-degree murder in 2004 and sentenced to life in prison, but the Pennsylvania Superior Court granted him a new trail, saying his attorney wasn't given enough time to prepare and testimony by Ross' girlfriend shouldn't have been allowed.

Miller's body was found by investigators partially submerged and bound with duct tape at Canoe Creek State Park after she was dropped off there by Ross, investigators said.
