Attorney suing Blair Co. officials for inmate's attack

A Cambria County attorney has filed a lawsuit in the wake of an unprovoked assault made by a death row inmate this past spring.

Tim Burns is suing the Blair County commissioners as well as the Blair prison board and sheriff. The attack in May left Burns initially unconscious and later with injuries including post-traumatic stress, dizziness and headaches.

The incident happened at the end of an appeal hearing for convicted killer Andre Staton. Witnesses said Staton was upset because a judge ruled against him at his hearing. Staton then reportedly "sucker punched" Burns using his handcuffed fists.

Burns' lawsuit claims that security should have been tighter in the courtroom and he is seeking in excess of $50,000 on each of five counts.

The commissioners had not commented on the lawsuit as of noon Tuesday.
