Judge says no to battered woman expert testimony


Its a victory for the Somerset Co. district attorney Wednesday morning with respect to an upcoming murder trial.  

County Judge John Cascio ruled that an expert on battered women will not be allowed to testify at the trial of Erin Everett.

Everett, 27, faces charges of first and third degree murder for the death of her roommate 21-year-old Tory Minnick in March 2011.

Everett is accused of bludgeoning the Minnick with a hammer and then shooting her in the head.  She was found in the Jerome home the two shared.  

Everett's attorney had asked that a doctor be allowed to testify about battered women syndrome and post-traumatic stress disorder.

The judge sided with prosecutors who argued Everett showed no signs of those conditions.  

Her trial is scheduled for October 1 with jury selection to begin one week earlier.
