June 13, 2012: Day 3 full of surprises

A bizarre day of testimony in day three of the Sandusky trial.

 

John McQueary takes the stand to bolster his son's case and provides the day’s most bizarre moment. When defense attorneys try to question him about his testimony during the preliminary hearing for Gary Schultz and Tim Curley McQueary simply says,

"I wasn't there".  Even though we saw him in Dauphin County court for the hearing and there's documentation of his testimony.  He stopped that line of questioning quick by denying he was at the hearing. Defense counsel looked stunned as Judge John Cleland told them to move on.

 

Alleged Victim 7 might of helped the defense's case more than the prosecution’s to the point of admitting he has an attorney and signed some type of document with him, but doesn't know what he signed.

 

But any gains the defense made in the morning were quickly lost in the afternoon.  First, prosecutors played the famous Bob Costas interview with Sandusky where Sandusky struggles to answer the question, "Are you sexually attracted to young boys?" The only issue:  the prosecution played an obviously edited audio track from the interview, in an attempt to bolster their case. 

 

Then the jury is allowed to hear the story of a Penn State janitor who says he saw Sandusky engaged in sex with a young boy in a campus shower room, except the janitor isn't medically able to testify directly.  So the story comes from another janitor who was also working that night.  He said his co-worker says he witnessed the shower scene. Generally hearsay evidence isn't allowed in court, but in this case we've seen a series of surprising turns.  I wouldn't be surprised if the defense team tries to raise an appeal about the Costas interview presentation, plus there's another brewing issue that could cause a delay.

 

Prosecutors are rolling at this point, saying what they expected to be a two week presentation of their case will be wrapped up by the end of this week.  

 

Witnessed one amusing thing in the courtroom, when one of the alleged victims testifies they don't have a lawyer yet, to then see most of the attorneys in the courtroom audience quickly head for the door.
